Privacy statement for the processing of personal data
MOODART SRLS with registered office in via Ciro Ferrari, 13, 37135 Verona (VR), VAT number and tax code 04134840232 (subsequently, “Holder”), as Data Controller under the terms of art. 13 Legislative Decre 30.06.2003 n. 196 (subsequently, “Privacy Code“) and of art. 13 EU Regulation no. 2016/679 (subsequently, “GDPR”) that Your data will be processed as and for the following purposes:
1. OBJECT OF PROCESSING
The Holder processes personal, identifiable and non-sensitive data (as an example, but not limited to, name, last name, company name, address, phone number, e-mail, date of birth – subsequently, “personal data” or “data”) you provide us with upon interacting with the Moodart.com web services, electronically accessible at the address: www.moodart.com (purely by way of example site registration, participation in opinion and satisfaction surveys, filling out subscription forms through the Site to events organized by the Holder, on-line requests for information or support requests and the receiving of newsletters) or provided by you for offline events organized by the Holder. The information is provided only for the website www.moodart.com and not for other websites that may be consulted by the user through links.
2. PURPOSE OF PROCESSING
Your personal data are processed:
A) for the following Service Purposes:
- manage and maintain the Site;
- allow You to benefit from the Services that may be requested by You;
- participate to initiative organized by the Holder (for example, events) through the Site;
- process a contact request;
- fulfill the obligations required by law by a regulation, by Community
- legislation or by an order of the Authority;
- prevent or discover fraudulent activities or abuses harmful to the Site;
- exercise the rights of the Holder, for example the right to exercise a right in court
B) Only with Your specific and distinct consent (art. 23 and 130 of the Privacy Code and art. 7 GDPR), for the following Other Purposes:
- send You opinion and satisfaction polls via e-mail, newsletters and/or invitations to events
- or subscribe You to events organized by or which the Holder is a part of.
We also inform that the computer systems and software procedures used to operate the website acquire, during their normal operation, some personal data for which transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified interested parties, but could, by its very nature, allow users to be identified through processing and data association held by third parties. This category of data includes IP addresses or computer domain names employed by users who connect the site, URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters related to the operating system and the computer environment of the user.
These data are only used to obtain anonymous statistical information on the use of the site and to check its correct functioning and are deleted immediately after processing. The data could be used to verify responsibility in case of hypothetical cyber crimes against the site: other than this possibility, at present the data on web contacts do not persist for more than seven days.
3. METHODS OF PROCESSING
The processing of Your personal data is carried-out by means of the operations indicated in art. 4 of the Privacy Code and art. 4 Codice Privacy and art. 4 no 2) GDPR and precisely: collection, registration, organization, conservation, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and data destruction. Your personal data are subject to both paper and electronic and/or automated processing, through the use of a website hosted on the Cloud managed by the company CLOUDNOVA srl – Via Riva del Grappa 18, Cittadella, PD – VAT: 04673080281.
The Holder will process personal data for the time that is required to fulfill the above-mentioned purposes and in any case for no more than 10 years from the termination of the relationship for Service Purposes and for no more than 5 years from the collection of data for Other Purposes.
4. SAFETY
The Holder has taken multiple safety measures to protect Your data against the risk of loss, abuse or alteration. In this regard he/she has taken the measures deemed appropriate pursuant to art. 32-24 of the Privacy Code and to art. 32 GDPR; in particular, specific safety measures have been adopted to prevent data loss, illicit or incorrect use, unauthorized access.
5. DATA ACCESS
Your data may be made accessible for the purposes referred to in art. 2.A) and 2.B):
- to the Holder’s employees and collaborators, in their quality of people in charge and/or internal data processors and/or system administrators;
- to third party companies or other subjects (for example web site providers, cloud providers, e-payment service providers, suppliers, hardware and software technicians, freight forwarders ad carriers, credit institutions, professional firms, etc.) who carry-out activities in outsourcing on behalf of the Holder, in their quality of data controllers.
6. DATA COMMUNICATION
Without Your express consent (ex art. 24 lett. a), of the Privacy Code and art. 6 lett. b) and c) GDPR), the Holder may communicate Your data for the purposes referred to in art 2.A) to Supervisory bodies, Judicial authorities and all other subjects to whom communication is mandatory by law for the fulfillment of said purposes. Your data will not be disclosed.
7. PLACE OF GIVEN DATA PROCESSING
The management and storage of personal data will take place at the Moodart Srls headquarters in via Ciro Ferrari 13, 37135 Verona. In case of need, the data related to the newsletter service may be processed at the headquarters of the Mail Up Spa company or at Cloudnova Srl, which is in charge of maintaining the technological part of the CRM.
8. DATA PROVISION NATURE AND CONSEQUENCES OF THE REFUSAL TO REPLY
The provision of data for the purposes referred to in art. 2.A) is mandatory. In their absence, we will not be able to guarantee You registration to the Site or the Services of art. 2.A).
The provision of data for the purposes referred to in art. 2.B) is optional. You can therefore decide to not provide any data or subsequently deny the possibility of processing data previously provided: in this case you will not be able to receive e-mail invitations to events, newsletters and opinion polls. In any case you will continue to have the right to the Services referred to In art. 2.A).
9. RIGHTS OF THE DATA SUBJECT
As data subject, you have the rights referred to in art. 7 of the Privacy Code and art. 15 of the GDPR and precisely the rights to:
- obtain a confirmation on the existence or not of personal data concerning You, even if not yet recorded, and their communication in intelligible form;
- obtain the indication of: a) the origin of the personal data; b) the purposes and methods of processing; c) the logic applied in the case of processing carried-out with the help of electronic tools; d) the owner’s identification details and the appointed representative pursuant to art. 5 paragraph 2 of the Privacy Code and art. 3, paragraph 1, GDPR; e) the people or categories of people to whom the personal data may be communicated or who may become aware of them as appointed representative in the territory of the State, as managers or people in charge;
- obtain: a) the update, the rectification, meaning, if You were to be interested, the integration of the data; b) the cancellation, the transformation in anonymous form or the blocking of the data processed violating the law, including those whose storage is not necessary in relation to the purposes for which the data were collected or subsequently processed; c) the attestation that the operations referred to in the letters a) and b)have been brought to the attention of those to whom the data have been communicated or disseminated, except where such task proves impossible or involves the use of means manifestly disproportionate to the right being protected;
- oppose, in whole or in part: a) for reasons legitimate to the processing of personal data concerning You, even if pertinent to the purpose of their collection; b) the processing of personal data concerning You for the purpose of sending advertising material or direct sales or for carrying-out market research or commercial communication, through the use of automated call systems without the intervention of an operator via e-mail or by traditional telephone marketing and/ or paper mail. It should be noted that the right of opposition of the person concerned, set out in the above-mentioned point b), for direct marketing purposes by using automated methods extends to the traditional ones and that, however, the possibility for the interested party to exercise, even in part, the right of opposition, remains. Therefore, the interested party can decide to receive only communications through traditional methods or only automated communications or neither of these two types of communication.
Where applicable, you also have the rights referred to in Artt. 16-21 GDPR (Rectification right, Restriction processing right, Right to be forgotten, Data Portability right, Right to opposition), as well as the right to complain to the Guarantor Authority.

11. MINORS
This Site and the Holder’s Services are not intended for children under 18 years of age and the Holder does not intentionally collect personal information relating to minors. In the case in which information on minors are involuntarily registered, the Holder will delete them in a timely manner, per user request.

The updated list of data controllers and people in charge of processing is kept at the Holder’s headquarters.
